1. Acceptance of Terms
By accessing or using the Everest Creator platform, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use our services. These terms apply to all visitors, users, and others who access or use the platform.
2. Description of Services
Everest Creator provides AI-powered image retouching, post-production, and visual content management services. Our platform enables businesses to upload, process, and manage product and editorial imagery at scale. Service availability, features, and pricing may change at our discretion with reasonable notice.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Payment Terms
Payment is due according to the billing cycle selected at the time of subscription. All fees are non-refundable except as expressly stated in our refund policy. We reserve the right to modify pricing with 30 days advance notice to active subscribers.
5. Intellectual Property
You retain all ownership rights to images and content you upload to our platform. By uploading content, you grant Everest Creator a limited license to process and deliver the images as part of our services. Our platform, technology, and branding remain the exclusive property of Everest Creator.
6. Limitation of Liability
To the maximum extent permitted by law, Everest Creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
7. Termination
Either party may terminate this agreement at any time with written notice. Upon termination, your right to access the platform ceases immediately. We will retain your data for 30 days following termination, after which it may be permanently deleted.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Delaware.
